1. Introduction & Acceptance

These Terms and Conditions govern all transactions, services, and interactions on the Bairwa Brothers platform. Bairwa Brothers operates in full compliance with the Consumer Protection (E-Commerce) Rules, 2020, ensuring transparency in pricing and policies. Official business registration details, legal entity information, operating addresses, and customer support contact channels are permanently displayed in the footer section of this website.

By accessing the Platform, creating an account, or placing an order, you ("you," "user," "customer") agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, please discontinue use of the Platform.

2. Eligibility

You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872, to place an order on the Platform. If you are under 18, you may use the Platform only with the involvement of a parent or legal guardian.

3. Account Registration

If you create an account, you agree to provide accurate, current information and to keep your login credentials confidential. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts reasonably suspected of fraudulent, abusive use, or use in violation of these Terms.

4. Products & Fabrics

4.1 Bairwa Brothers offers premium unstitched fabrics, pure flax linens, Chanderi silks, organic cotton prints, and artisan handloomed textiles. We source our textiles ethically and directly from regional weavers and block printers.

4.2 All handloom and silk products are crafted using traditional Indian techniques. Natural imperfections in weaves, dye slubs, and color variations are characteristic of artisan craftsmanship and are not considered manufacturing defects.

4.3 Product images are for representational purposes. Due to studio lighting, screen calibration, and the handcrafted nature of textiles, actual color, drape, and minor pattern alignments may vary slightly from images shown. Fabric cuts are measured as accurately as possible, subject to reasonable cutting tolerances.

4.4 We reserve the right to discontinue any fabric, limit order quantities, or modify product specifications at our discretion without prior notice.

5. Pricing & Payment

5.1 All prices are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless otherwise stated. Prices are subject to change depending on fiber market rates and production costs.

5.2 For international orders, applicable prices, currency, shipping charges, and any customs duties or import taxes will be indicated at checkout or communicated separately; such additional charges (if any) are the customer's responsibility.

5.3 Payments are accepted via Razorpay (including UPI, debit/credit cards, net banking, and wallets, as enabled) for both domestic and international purchases. Cash on Delivery is not available.

5.4 In the event of a pricing or product description error caused by a technical glitch or human error, we reserve the right to cancel the affected order and issue a full refund, even after order confirmation.

5.5 An order is confirmed only once payment is successfully processed and you receive an order confirmation email/SMS. If an item becomes unavailable, we will notify you and process a full refund.

6. Order Cancellation & Refunds

6.1 Standard catalog fabric orders may be cancelled at any time before they are dispatched by contacting our customer support team at support@bairwabrothers.com. Custom-dyed, custom-woven, or personalized fabric orders cannot be cancelled once production has commenced.

6.2 Once dispatched, an order cannot be cancelled and is instead subject to our Exchange Policy.

6.3 We reserve the right to cancel any order due to suspected fraud, pricing errors, or non-availability of fabric stock, with a full refund of amounts paid.

6.4 Valid refunds will be processed to the original payment method within 15 business days, subject to payment gateway processing timelines.

7. Shipping & Delivery

7.1 We ship across India and internationally, through Shiprocket and its network of reliable courier partners.

7.2 Delivery timelines shown at checkout are estimates only and are not guaranteed; they may be affected by location, courier delays, customs processing (for international orders), or circumstances beyond our control.

7.3 For international orders, the customer is solely responsible for any customs duties, import taxes, levies, or other charges imposed by the destination country.

7.4 Risk in the goods passes to you upon delivery to the address provided; please inspect your package on delivery and report any visible tampering or damage immediately to the delivery agent and to our customer support team.

8. Exchange & Return Policy

8.1 We offer a 7-day exchange-only policy from the date of delivery. We do not offer returns or refunds for change of mind. Please note that our 7-day exchange policy applies only to standard catalog fabric items.

8.2 Custom-dyed, custom-woven, or cut-to-measure fabrics that have been washed, cut, or tailored by the customer are strictly non-returnable and non-exchangeable, except in the case of a manufacturing defect or transit damage.

8.3 To be eligible for exchange, the fabric must be unused, unwashed, uncut, and returned in its original condition with all original packaging and invoice tags intact.

8.4 To initiate an exchange, contact customer support within 7 days of delivery with your order number and reason for exchange.

8.5 In the event an exchange is authorized due to a manufacturing defect, transit damage, or an incorrect item dispatched by Bairwa Brothers, we will bear the return shipping logistics and costs. For all other authorized exchanges, the customer is responsible for bearing the return shipping costs. The customer assumes responsibility for the safe transit of returned fabrics.

8.6 Exchanges are subject to product availability. If the requested replacement fabric is unavailable, we will offer store credit or an alternative product of equivalent value, at your choice.

9. Care Guidelines & Limitations

9.1 Handloom, vegetable-dyed, and indigo-printed cottons may bleed color during initial washes due to the nature of natural dyes. Bairwa Brothers is not liable for color transfers, running, or shrinkage resulting from improper laundering methods.

9.2 We recommend dry cleaning for all premium silks and Chanderi blends, and gentle hand washing in cold water with mild detergent for cottons and linens, drying them in shade.

10. Intellectual Property

10.1 "Bairwa Brothers," our logo, fabric prints, photographs, and all website/app content are the intellectual property of Bairwa Brothers. Any unauthorized use of our branding, designs, or images without our prior written consent is strictly prohibited.

10.2 You may not copy, reproduce, scrape, republish, or create derivative works from any Platform content without our prior written consent.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Subject to your statutory right as a consumer, any other dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at Bhilwara, Rajasthan.

12. General Provisions

12.1 Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.

12.2 Waiver: Our failure to enforce any right or provision will not be considered a waiver of that right.

12.3 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bairwa Brothers regarding use of the Platform.

12.4 Amendments: We may revise these Terms periodically. The updated Terms will be posted here with a revised "Last Updated" date; continued use of the Platform constitutes acceptance.
